If you have been arrested for a misdemeanor crime, like ones listed below, you could go to jail. Misdemeanors are either 1st Degree or 2nd Degree in Florida.

A 1st Degree Misdemeanor is punishable by up to 1 year in County Jail and up to $1,000.00 in fines.

A 2nd Degree Misdemeanor is punishable by up to 60 days in County Jail with up to $500.00 in fines. Some examples of these crimes are as follows:

  • DUI (1st Degree)
  • Petit Theft (1st or 2nd Degree)
  • Domestic Battery (1st Degree)
  • Trespass (1st or 2nd Degree)
  • Driving on a Suspended License (1st or 2nd Degree)
  • Domestic Battery (1st Degree)
  • Possession of Marijuana (1st Degree)
  • Leaving the Scene of an Accident (1st Degree)
  • Carrying a Concealed Weapon (not a firearm – that’s a felony)

If this is your first offense, chances are – you will not go to jail. You will most likely get probation. If this is your first arrest – you need a good criminal defense attorney.
